1. Who we are

This website is operated by Olaf Wollmerstedt, a self-employed visual artist based in Vila Nova de Cacela, Portugal (NIF: 306329425). For any questions, please use the contact form on this website.

2. Scope

These Terms & Conditions apply to all purchases made through olafcreates.com. By placing an order you agree to these terms. Please read them carefully before purchasing.

3. Products

I sell two types of products: original hand-painted artworks and printed reproductions. Each original is a unique, one-of-a-kind work. Product descriptions, dimensions, and images are provided in good faith. Due to differences in screen calibration, colours may vary slightly from what you see on your device. Such variation does not constitute a defect.

4. Pricing and payment

All prices are displayed in Euros and include applicable taxes. Payments are processed securely via Squarespace Payments, Stripe, or PayPal. I reserve the right to correct pricing errors before an order is fulfilled.

5. Shipping

I ship worldwide. Shipping costs and estimated delivery times are shown at checkout. All orders are carefully packaged. Once a shipment is handed to the courier, I am not responsible for delays, losses, or damage caused by the carrier. For international orders outside the EU, customs duties and import taxes are the buyer's responsibility.

6. Right of withdrawal — 14-day cooling-off period (EU customers)

In accordance with EU consumer law (Directive 2011/83/EU), customers based in the EU have the right to withdraw from their purchase within 14 days of receiving their order, without giving any reason.

To exercise this right, please notify me within 14 days of delivery using the contact form. You then have a further 14 days to return the item. The item must be returned in its original condition and packaging, unused and unaltered. Return shipping costs are the buyer's responsibility. I will issue a full refund, including the original shipping cost, within 14 days of receiving the returned item in satisfactory condition.

Customers outside the EU are not entitled to this right under EU law. Returns from non-EU customers will be considered on a case-by-case basis at my sole discretion.

7. Prints — returns and refunds

In addition to the 14-day withdrawal right above, I accept returns on printed reproductions within 14 days of delivery, provided the item is returned in its original, undamaged condition. Return shipping costs are the buyer's responsibility.

8. Original artworks — transit damage

Each original artwork is unique and irreplaceable. I take great care in packaging all originals for safe transit.

If your order arrives visibly damaged, you must:

  • Refuse delivery where possible, or note the damage with the courier at the time of delivery

  • Contact me within 48 hours of delivery using the contact form

  • Provide clear photographic evidence of the damage to both the packaging and the artwork

Claims made after 48 hours, or without photographic evidence, cannot be accepted.

Where transit damage is confirmed, I will offer a full refund. Since original artworks are unique and cannot be replaced, no replacement will be offered. This is the sole remedy available for transit damage.

This policy does not cover damage occurring after delivery, including damage caused by improper handling, storage, or display. The 2-year EU legal guarantee applies to genuine manufacturing or material defects, not to the subjective artistic nature of the work or minor variations inherent to hand-made pieces.

9. Intellectual property

All artworks, images, and content on this website are the intellectual property of Olaf Wollmerstedt. Purchasing a work transfers physical ownership only — copyright is retained by the artist. You may not reproduce, distribute, or use any image or artwork commercially without prior written consent.

10. Dispute resolution

I will always try to resolve any issue directly and fairly. If we cannot reach an agreement, you may contact the Portuguese consumer protection authority (DECO at deco.pt) or use the EU Online Dispute Resolution platform at ec.europa.eu/odr. The applicable law is Portuguese law.

11. Livro de Reclamações

In accordance with Portuguese law, you have the right to file a complaint via the Livro de Reclamações Eletrónico at livroreclamacoes.pt.

12. Changes to these terms

I may update these terms from time to time. The date at the top of this page always reflects the latest version.
